NANTICOKE – A 26-year old Nicholson man was arraigned at 4 p.m. Friday in District Judge Donald Whittaker’s court on child abuse charges.
Cody Quick was charged with simple assault, reckless endangerment and endangering the welfare of children after injuring his girlfriend’s seven-week old baby girl while the couple lived in Pittston, police said.
Quick’s bail was set at $75,000.
According to the criminal complaint:
The baby was treated at Wilkes-Barre General Hospital on Aug. 8, Aug. 22 and Oct. 31 where it was determined the baby suffered from a fractured skull, broken rib and broken leg.
“The injuries were in different stages of healing, indicating they occurred at different times,” the complaint stated.
Quick’s attorney Paul Ackowrey said Friday after the hearing the child apparently suffered some injuries, but his client did not cause them.
“He doesn’t know what happened. There were several people who had access to the child,” Ackowrey said.
During a police interview, Quick said he was sure the baby’s mother had not caused the injuries, but conceded he might have by being too rough with the baby.
When confronted by police that either he or the baby’s mother caused the injuries, Quick said there were times he turned the baby over “too fast and rough” by grabbing the baby and turning her over with one hand.
Quick, who is not the baby’s biological father, told police he never wanted children and would at times drop the baby into her crib. He demonstrated this by holding his hands as if he was holding the baby and then separating his arms about 1.5 to 2 feet above the table.
“During the interview, the defendant began crying for a time saying that he was a ‘terrible person’ and saying that he was ‘too rough’ with the victim,” the complaint stated.
Ackowrey requested the judge release his client on his own recognizance noting he’s been cooperating with police since the beginning of this ongoing investigation.
He said his client was not a flight risk and just recently re-enlisted in the National Guard for another six years.
Whittaker denied the request saying the bail was not a representation of his possible guilt, but a way to ensure the defendant would appear for his next court appearance.
Quick is scheduled for a preliminary hearing Dec. 27 in Central Court in Wilkes-Barre.
He’s being lodged at the Luzerne County Correctional Facility.
